Terms of Service and License Agreement

1. Acceptance of Terms

By registering for and using any Acreetion service ("the Services"), you ("the User") agree to be bound by these Terms of Service and License Agreement ("Agreement"). If you do not agree to these terms, you must not use the Services.

2. Nature of Services

All software powering our Services is free and open-source. However, hosting requires real infrastructure: VPS servers, bandwidth, storage, electricity, moderation, and maintenance. Charges for paid tiers exist to cover these operational costs.

GitLab is always free and has no pricing tier. We believe developer tools should be accessible to all and fund it through our other offerings.

Natalie and Darren are operator accounts. They have unlimited access across services because they operate and pay for the VPS infrastructure.

3. Available Services

  • Nextcloud: File storage, sync, and collaboration. Free: 10GB. Paid tiers: 50GB–500GB with varying speeds.
  • Mastodon: Decentralized social media. Free to use with X-like fair-use restrictions. Optional supporter subscriptions help fund hosting.
  • Bluesky PDS: Personal Data Server for the AT Protocol. Free to use with X-like fair-use restrictions. Optional supporter subscriptions help fund PDS hosting and media storage.
  • XMPP: Encrypted real-time messaging. Free: 100GB/week data transfer. Supporter: 1TB/week data transfer.
  • Immich: Photo and video backup with AI. Free: 15GB. Pro: 45GB at $30/month.
  • GitLab: Source code management and CI/CD. Always free.

4. User Accounts

4.1 You must be at least 13 years old to create an account.

4.2 You are responsible for maintaining the confidentiality of your account credentials.

4.3 You agree to provide accurate and complete registration information.

4.4 Acreetion reserves the right to suspend or terminate accounts that violate this Agreement.

5. Payment Terms

5.1 Paid subscriptions are billed monthly. Prices are listed per service. Social media supporter subscriptions are optional and are not required for account access.

5.2 All prices include applicable taxes and fees as required by law.

5.3 Payments are processed securely through Stripe (2.9% + $0.30 per transaction).

5.4 Subscriptions auto-renew until cancelled. You may cancel at any time and retain access until the end of your billing period.

5.5 Refunds are handled on a case-by-case basis.

5.6 Non-payment for 30 days may result in account suspension. Content may be deleted after 60 days of non-payment.

6. Telemetry Data Collection and Usage

6.1 By using any Acreetion Service, you expressly consent to the collection, processing, and commercialization of telemetry data.

6.2 We collect the following telemetry data:

  • Service usage patterns and frequency
  • Storage utilization metrics
  • Feature usage statistics
  • Device and client information
  • Performance and error logs
  • Upload and download activity (metadata only, not content)
  • Bandwidth consumption patterns

6.3 Acreetion reserves the right to sell, license, or otherwise commercialize aggregated and anonymized telemetry data to third parties. This data may be used for:

  • Market research and analytics
  • Product development and improvement
  • Business intelligence and reporting
  • Infrastructure planning and optimization
  • Any other lawful commercial purpose

6.4 Acreetion will NOT sell, share, or provide access to your actual files, photos, messages, posts, or personal content to any third party.

6.5 Telemetry data is aggregated and anonymized before commercialization. Individual user data is not sold in identifiable form.

6.6 This telemetry revenue helps offset hosting costs, allowing us to keep services affordable and GitLab free for all users.

7. Content Ownership

7.1 You retain all ownership rights to the content you upload or create using our Services.

7.2 By using our Services, you grant Acreetion a license to store, display, and process your content solely for the purpose of providing the Services to you.

7.3 Acreetion does not claim ownership of your content, code, files, messages, or posts.

8. Acceptable Use

You agree not to:

  • Upload illegal content or content that infringes on others' rights
  • Use the Services for any unlawful purpose
  • Attempt to gain unauthorized access to the Services or other users' accounts
  • Use the Services to distribute malware or malicious content
  • Excessively consume resources in a way that degrades service for others
  • Reverse engineer or attempt to exploit the underlying infrastructure

9. Resource Limits

9.1 Each service tier has defined storage, bandwidth, or fair-use limits. XMPP free accounts are limited to 100GB/week of data transfer; XMPP supporter accounts are limited to 1TB/week. Natalie and Darren operator accounts are unlimited.

9.2 Exceeding your quota will result in upload/posting restrictions until you either reduce usage or upgrade your plan.

9.3 We reserve the right to implement fair-use policies to prevent any single user from degrading the experience for others.

10. Limitation of Liability

10.1 Acreetion provides the Services "as is" without warranties of any kind, express or implied.

10.2 Acreetion is not liable for any loss of data, content, or profits arising from use of the Services.

10.3 We strongly recommend maintaining your own backups of important content.

10.4 Acreetion's total liability shall not exceed the amount you have paid in the 12 months preceding the claim.

10.5 We do not guarantee 100% uptime. Scheduled maintenance and unexpected outages may occur.

11. Termination

11.1 Acreetion may terminate or suspend your account at any time for violations of this Agreement.

11.2 You may delete your account at any time. Upon deletion, your content will be removed within 30 days.

11.3 For paid services, non-payment for 30 days may result in suspension; content may be deleted after 60 days of non-payment.

12. Governing Law

This Agreement shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved in the jurisdiction where Acreetion operates.

13. Changes to Terms

Acreetion reserves the right to modify this Agreement at any time. Continued use of the Services after changes constitutes acceptance of the new terms. We will notify users of material changes when possible.
